2. General terms and conditions of use (app)
Terms and conditions for the online shop (buddysim.com)
By accessing or using the digital services of 7 Marketplace GmbH, Vorgebirgsstraße 11, 53913 Swisttal, Germany (hereinafter “Provider" or "BuddySIM”), especially via the website www.buddysim.com or via mobile applications and platforms of sales partners, the user declares that he has read and accepted the Privacy Policy and the general terms and conditions (GTC).
By using the services - regardless of whether the purchase is made directly via the BuddySIM Shop or via an authorized sales partner - a legally binding contract is concluded between the user and 7 Marketplace GmbH.
The user expressly assures that he is legally authorized to conclude such a contract and has full legal capacity within the meaning of the applicable legal provisions.
1. Scope
1.1 These Terms and Conditions (GTC) apply to all contracts between 7 Marketplace GmbH, Vorgebirgsstraße 11, 53913 Swisttal, Germany (hereinafter “Provider” or “BuddySIM”), trading under the BuddySIM brand, and the customer regarding the purchase and use of digital eSIM data packages that are concluded via the online platform or the mobile application of an authorized sales partner.
1.2 The specific performance features and country-specific usage instructions can be found in the product information sheet of the booked data package. This is provided to the customer by the provider or sales partner before purchase and is part of the contract.
1.3 Differing conditions from the customer only apply if they have been expressly agreed to in writing.
2. Subject matter of the contract and services
2.1 7 Marketplace GmbH, trading under the BuddySIM brand, offers the customer digital prepaid eSIM data packages for the use of mobile data services on eSIM-compatible devices. The services are available both via our own online shop www.buddysim.com as well as via authorized sales partners.
2.2 The ordering, payment and provision of the eSIM takes place - depending on the sales channel - either via the BuddySIM website or via the infrastructure of an authorized sales partner. Payment is processed via common payment service providers, in particular Stripe, Shopify, PayPal or as part of a technical integration with the respective sales partner.
2.3 The eSIM is provided to the customer electronically without undue delay after conclusion of the contract, e.g. by email, WhatsApp or the web application and app of the respective sales partner. The necessary information for installation and activation is supplied to the customer or made available electronically.
2.4 Consent to these Terms and Conditions is required in order to use the services. As part of the purchase and registration, the customer provides certain personal data, in particular first name, last name, email address and billing address.
2.5 The customer is obliged to check on his own responsibility before ordering whether his device is eSIM compatible and not network-bound. A non-binding compatibility overview is available below www.buddysim.com/check available. The responsibility for the accuracy of the information lies with the customer.
2.6 The provider undertakes to provide the contractually owed services with the usual level of care and technical accuracy. There is no guarantee that use will be uninterrupted, error-free or available at all times.2.7 The customer undertakes not to use the services unlawfully, abusively or fraudulently. In the event of violations, the provider reserves the right to temporarily or permanently block access to the service. The obligation to pay remains unaffected.
3. Start of contract, activation and validity
3.1 The contract between the customer and 7 Marketplace GmbH, trading under the BuddySIM brand, is concluded upon completion of the ordering process via the online shop or an authorized sales partner.
3.2 Activation of the eSIM purchased at buddysim.com must occur within 60 calendar days of the purchase date. If it is not activated within this period, the eSIM will expire without replacement. There is no entitlement to a refund afterwards. Activation of the eSIM purchased through a reseller must occur within 6 months of the purchase date. If it is not activated within this period, the eSIM will expire without replacement. There is no entitlement to a refund afterwards.
3.3 The period of use of the booked data package begins with the first connection of the eSIM to a foreign mobile network (roaming) and is - depending on the package selected - 7, 15 or 30 calendar days.
3.4 The period of validity of an unused eSIM depends on the offer conditions valid at the time the contract is concluded. For eSIM products that before May 6, 2025 were purchased, an activated validity of 12 months applies from the date of purchase, regardless of the data volume booked. The eSIM must be activated for the first time within this period. If no activation occurs within the deadline, the credit will expire without replacement. Regardless of the respective package term, the eSIM remains valid for a period of twelve (12) months after each active use (data connection abroad). For eSIM products that after May 6, 2025 were purchased, an activated validity of 6 months applies from the date of purchase, regardless of the data volume booked. Regardless of the respective package term, the eSIM remains valid for a period of six (6) months after each active use (data connection abroad). Within this period, it can be used again or topped up with a new data package (top-up). If it is not used again within this period, the eSIM profile will be automatically deactivated and can no longer be used. The validity period of a data package (7, 15 or 30 days) begins with the first use of at least 1KB of data volume in the respective network of the destination country. After use, an eSIM can be recharged and reused as often as you like. After the expiry of the respective validity period, the eSIM loses its validity and the end user needs a new eSIM. Different, especially shortened, validity periods apply to time-limited special offers, including free packages or promotions. The applicable deadlines will be clearly communicated as part of the corresponding campaign. Promotion bundles that are not activated within the specified time period may be automatically deactivated or removed upon expiration.
3.5 The contract ends automatically when the eSIM is deleted from the smartphone, the expiry of the booked data package term and/or when the eSIM expires in accordance with paragraphs 2 or 4. Separate termination by the customer is not necessary.
4. Prices and payment terms
4.1 The ordering, payment and provision of the eSIM takes place - depending on the sales channel - either via the BuddySIM online shop at www.buddysim.com or via the infrastructure of an authorized sales partner.
4.2 Payment is processed via external payment service providers, in particular Stripe, Shopify, PayPal, Apple Pay or Google Pay. If you use an authorized sales partner, processing can take place directly via their platform. In this case, tokenized payment data (e.g. payment tokens and transaction references) is securely transmitted to BuddySIM for final billing without complete payment information being processed or stored by BuddySIM.
4.3 All payments are made in Euros (€), unless expressly stated otherwise.
4.4 All prices stated are gross prices including VAT, unless expressly stated as net prices.
4.5 The customer is only entitled to offset undisputed or legally established counterclaims against claims of 7 Marketplace GmbH.
5. Customer Obligations
5.1 Before concluding the contract, the customer is obliged to check on his own responsibility whether his device is technically suitable for using an eSIM, in particular whether it is eSIM compatible, activated (network independent) and suitable for international mobile phone connections. A non-binding overview of supported devices is available below www.buddysim.com/check available. The provider assumes no liability for functionality on devices that are not mentioned on the list or are not properly activated.
5.2 The customer undertakes to use the eSIM data packages provided exclusively within the scope of the contractually agreed purpose, in particular only for approved mobile data use.
5.3 Abusive, illegal or inappropriate use, including - but not limited to - commercial distribution, manipulation of the network configuration, faking a location (e.g. using VPNs to circumvent geographical restrictions), automated data retrieval or other non-contractual use entitles the provider to immediately block or delete the eSIM profile without prior notice.
5.4 A claim for reimbursement in the event of blocking as a result of a violation in accordance with paragraph 5.3 is excluded.
5.5 The customer is obliged to keep access data, QR codes and installation information securely and not to make them accessible to third parties. Passing on or copying the eSIM for use by third parties is expressly prohibited.
5.6 The customer further undertakes to comply with all applicable national and international legal regulations when using the eSIM, in particular those of the respective country of residence.
6. Refund/Cancellation/Change Policy
If the customer is a consumer within the meaning of §13 BGB, he is entitled to a right of cancellation in accordance with the statutory provisions. The details on the right of cancellation, the conditions for a refund and the early expiry of the right of cancellation for digital content can be found in the separate Cancellation policy, which is part of these Terms and Conditions.
6.1 Right of cancellation and refund conditions
6.1.1 Consumers within the meaning of §13 BGB generally have a right of cancellation for fourteen (14) days from the date of purchase, provided the eSIM has not yet been activated or used. Use occurs in particular when the eSIM has been installed on a device and connected to a mobile network.
6.1.2 A full refund is possible under the following conditions: the eSIM was neither installed nor activated, or the eSIM was only installed but the booked data package was not activated, i.e. There is no connection to the foreign network.
6.1.3 A partial refund may be granted at BuddySIM's discretion if: the eSIM was activated, but the data volume remained more than 99% unused, and/or the data package was not usable due to proven technical faults for which BuddySIM is responsible. 6.1.4 The decision on the refund will be made within five (5) working days of receipt of a legitimate request. Repayment will be made within a reasonable period of time, but at the latest within thirty (30) calendar days, depending on the payment service provider and the customer's bank.
6.2 Application
6.2.1 Refund requests must be submitted in writing to refund@buddysim.com. The customer is obliged to provide all information required for verification, in particular: proof of purchase, information about the eSIM used (ICCID or order number), description of the problem, if applicable. technical evidence such as screenshots, settings or bug reports.
6.2.2 Compliance with the refund period of 14 calendar days from the date of purchase is a prerequisite for processing the application. Refunds after this period are excluded.
6.3 Exclusions and special cases
6.3.1 No refund or credit will be given for: use of alternative devices, SIM cards, providers or other telecommunications services that were not provided via BuddySIM; accidental purchases if the eSIM has already been activated - in which case it is considered used; costs that are not directly related to the BuddySIM service (e.g. hotel telephones, roaming fees due to misconfiguration); deleted eSIMs after use: A refund is valid excluded if the eSIM was removed or deleted from the device after activation without prior consultation with support.
6.3.2 BuddySIM reserves the right to refuse refunds at any time in the event of proven misuse, violation of these Terms and Conditions or fraudulent use. If fraud or misuse is suspected, the customer account in question may be blocked.
6.3.3 For unauthorized or unauthorized purchases, a refund will only be made after individual review and approval by the provider.
6.4 Incorrect invoice amounts
6.4.1 If the customer objects to an invoice amount in good faith, the objection must be made in writing within fourteen (14) days of receipt of the invoice. The customer must explain which amounts he considers to be incorrect, why the calculation is incorrect, and which amount is considered correct.
6.5 Refund in the event of a network outage guarantee
6.5.1 BuddySIM offers a network outage guarantee in the event that you do not have internet access in your destination country for a continuous period of more than 90 minutes. In such a case, we will refund you 100% of the costs for the affected eSIM. The network outage guarantee only applies if it can be proven that the internet outage is due to a network disruption or an error in the BuddySIM service. A screenshot with date and time stamp or a screen video is required as proof that the correct network and APN settings were active during the outage.
6.5.2 Refunds will only be made in cases of proven technical unavailability of the service if a mobile data connection cannot be established despite proper installation and the user's active participation in the support process. A general right of cancellation or cancellation beyond the statutory provisions is excluded.
6.5.3 BuddySIM grants a network failure guarantee in the event of a verifiable, uninterrupted failure of the mobile Internet service for a period of more than 90 minutes, provided that this failure is due to a technical fault for which BuddySIM is responsible. The prerequisite for claiming the network failure guarantee is that the user submits suitable evidence in a timely manner, such as screenshots, connection test protocols or comparable evidence that enables the failure to be traced.
6.6 Goodwill policy
6.6.1 Refund requests that do not fall under the above regulations will be examined on a case-by-case basis. Approval is only granted on a goodwill basis. In exceptional cases where a refund is granted outside of the regular refund conditions, a processing fee of a maximum of five (5) EUR may apply. The amount depends on the actual audit and administrative effort.
6.6.2 The maximum refund amount may in no case exceed the total amount originally paid.
7. Fair Use Policy for “Unlimited” products
[You can use 1GB of data daily at full speed. Once you reach this limit, the speed will be reduced to 5 Mbps for the rest of the day. The next day, from 12:00 a.m. in the time zone where you are, you will receive 1 GB of high-speed data again.

• Download: A 1GB file will download in about half an hour.
• Streaming: You can conveniently stream HD content on one device without interruptions. Multiple devices can stream content in standard quality at the same time.
• Other activities: Smooth web surfing, video conferencing and online gaming are still possible with acceptable latency.
What does throttling mean?
Throttling means a temporary reduction in your network speed after you exceed your daily data limit. This is a common practice to manage network resources and ensure that all users can enjoy a stable and reliable connection.]
7.1 A fair use policy applies to eSIM bundles labeled “Unlimited” to ensure network quality and stability for all users.
7.2 The user has a daily high-speed data volume of 1GB available. Once this volume has been reached, the bandwidth is automatically reduced to up to 5Mbps until midnight (local time in the country in which you are staying).
7.3 The reduced bandwidth still allows use for the following purposes: downloading files (e.g. 1GB in approx. 30 minutes), HD streaming on a device without interruptions, smooth surfing, online gaming and video conferences with acceptable latency.
7.4 The use of the data connection via mobile hotspots (tethering) is subject to the same regulations as direct use on the end device.
7.5 Bandwidth throttling is an automated technical measure and is carried out exclusively to ensure an even distribution of network resources in accordance with the Fair Use Policy.
Important note in the event of exceptionally high data consumption: With an exceptionally high data consumption per day (e.g. more than 10GB) Your data usage may be subject to an automated check. In such cases, the transmission speed may be temporarily reduced or data access may be restricted. This serves to protect the network from overload by individual users.
Please note: These measures will exclusively carried out by the local network operator carried out. BuddySIM has no influence on this process and can neither prevent nor remove throttling.
Example: If you use a particularly large amount of data volume during peak times - for example through constant streaming or large uploads - you may notice a temporary reduction in speed or your access will be limited. This is a common practice to maintain network quality and usually only affects users with consumption that is significantly above average. So even with so-called “Unlimited” tariffs, restrictions apply in accordance with the fair use policy of the respective network operator. One excessive or abusive use can lead to throttling - this is to be fair to other users on the same network.
8. Liability and Disclaimers
8.1 BuddySIM is liable within the scope of the legal provisions exclusively for damages that are based on intentional or grossly negligent breach of duty. In the event of a slightly negligent violation of essential contractual obligations (cardinal obligations), liability is limited to the foreseeable damage that is typical for the contract. Any further liability – particularly for indirect damage, consequential damage or loss of profit – is excluded.
8.2 BuddySIM does not guarantee that the services or network connections offered will be available at all times, uninterrupted or error-free. In particular, the quality and availability of mobile Internet access from third-party providers (e.g. local network operators abroad) cannot be guaranteed.
8.3 The customer is responsible for the proper installation, activation and configuration of the eSIM on his device. BuddySIM is not liable for damages or malfunctions resulting from incorrect or incomplete installation of the eSIM, improper configuration or incorrect settings, use of a non-eSIM-compatible or locked device or failure to follow the instructions provided by BuddySIM.
8.4 BuddySIM is not liable for roaming fees or other costs that arise as a result of the eSIM profile not being installed correctly or being deactivated, mobile data connections remaining active (e.g. via a different SIM card), the customer not properly configuring their mobile tariff, or a parallel connection being caused via the physical SIM.
8.5 BuddySIM assumes no liability for damage or loss resulting from the loss, theft or misuse of the device or the eSIM by unauthorized third parties.
8.6 By purchasing and using an eSIM product from BuddySIM, the customer declares that they have read these liability provisions. Any further claim for damages is excluded to the extent permitted by law.
8.7 In the event of technical uncertainties or problems, the customer is expressly recommended to Contact customer support at support@buddysim.com before carrying out the configuration independently.
9. Final provisions
9.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The legal regulations restricting the choice of law for consumers abroad remain unaffected.
9.2 If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is the registered office of 7 Marketplace GmbH, currently in 53913 Swisttal, Germany.
9.3 Changes and additions to these general terms and conditions must be made in writing. This also applies to the cancellation of the written form requirement itself, unless a stricter legal form is prescribed.
9.4 Should a provision of these Terms and Conditions be or become wholly or partially invalid or unenforceable, the effectiveness of the remaining provisions remains unaffected. Instead of the invalid provision, the regulation that comes closest to the economic purpose is deemed to have been agreed.
9.5 The European Commission provides a platform for online dispute resolution (OS platform), which you

These Terms and Conditions govern your use of the BuddySIM app and our eSIM services. Please read them carefully.
1. Scope & Provider
These Terms and Conditions of Use (T&Cs) apply to contracts for digital prepaid eSIM data packages concluded via the BuddySIM app, the website www.buddysim.com or authorized sales partners. The provider is 7 Marketplace GmbH (“BuddySIM” brand), Vorgebirgsstraße 11, 53913 Swisttal, Germany. By using our services, you declare that you have read these terms and conditions and the Privacy Policy and agree to them.
2. Minimum age & Legal capacity
The use of the services and the conclusion of the contract require that you have reached the age of 18 and have full legal capacity. By ordering you confirm this.
3. Subject of the contract & Services
BuddySIM offers digital prepaid eSIM data packages for mobile data services on eSIM-enabled devices in over 195 countries. It is provided digitally via email, WhatsApp or via partner applications. You are responsible for checking the eSIM compatibility and network unlocking of your device before purchasing (overview: www.buddysim.com/check). The specific performance features can be found in the respective product information sheet, which is part of the contract.
4. Start of contract, activation & validity
The contract is concluded upon completion of the order. The activation period is 60 days for direct purchases or 6 months for purchases through a partner. The period of use of the package (e.g. 7, 15 or 30 days) begins with the first use of data (at least 1 KB) in the network of the destination country. For purchases made from May 6, 2025, an activated validity of 6 months applies from purchase; After each active use, the eSIM remains valid for another 6 months and can be recharged again. Purchases made before May 6, 2025 are valid for 12 months. If there is no (re)use within this period, the eSIM profile will be deactivated.
5. Accounts
You can use our services as a guest or with a registered account. You are responsible for the security of your account and all activities associated with it. Access data may not be passed on to third parties.
6. Prices & payment
All prices are in euros (€) including statutory VAT. Payment is made via Stripe, Shopify, PayPal, Apple Pay or Google Pay; For Apple Pay and Google Pay, their terms and conditions also apply. BuddySIM does not store complete payment data - these are only processed by the respective payment service provider.
7. Cancellation, expiry of the right of cancellation & refund
Consumers have a 14-day right of cancellation. Since this involves the provision of digital content, when purchasing you expressly agree that we will begin execution before the cancellation period has expired and confirm that you will thereby lose your right of cancellation with complete fulfillment of the contract (Section 356 Para. 5 BGB). As long as the eSIM has not been installed or has been installed but not used, we will refund the full amount. A proportional refund is possible if more than 99% of the data volume is unused or a technical defect is proven. If there is a proven, continuous network failure of more than 90 minutes in the destination country, we will refund 100% of the purchase price (“No Net – No Pay” guarantee). This guarantee applies exclusively to actual network failures of the mobile network. There is no claim for dead spots due to a lack of network coverage or a lack of cell phone towers. To avoid misuse, we reserve the right to request photo or video evidence of the failure. We will decide on refunds within 5 working days; The payment will be made within 30 calendar days. We provide cancellation instructions and a sample cancellation form separately.
8. eSIM usage, tariffs & Fair Use Policy
eSIMs are tied to your device and are not transferable. Commercial reselling/sharing, network manipulation, circumventing geolocation via VPN and automated mass data retrieval are prohibited. Depending on the tariff, the following applies to the data speed:
- Fixed data volume packages (Fixed GB): full available speed (LTE/4G/5G, where available) without throttling until the booked volume is used up.
- Unlimited Light: 1 GB of unthrottled high-speed data volume (5G, where available) per 24 hours, then unlimited data volume of up to 512 kbit/s.
- Unlimited Essential: 1 GB of unthrottled high-speed data (5G, where available) per 24 hours, then unlimited data at up to 1.25 Mbps.
- Unlimited Premium: 2 GB of unthrottled high-speed data volume (5G, where available) per 24 hours, then unlimited data volume at up to 2 Mbit/s.
- For all Unlimited plans, the 24-hour period begins with the first use of the package; The unthrottled high-speed quota is automatically reset every 24 hours for the period of validity (according to the network partner's Technical Service Agreement). The applicable high-speed quota will be displayed to you before purchase and in the app; The product information sheet for the selected package is decisive.
9. DataMiles (loyalty program)
With the BuddySIM loyalty program you collect DataMiles (DM), e.g. B. for purchases and recommendations. DataMiles have no cash value, are non-transferable and non-payable. They expire 24 months after crediting unless redeemed. We may adjust the program, redemption and expiration rules with effect going forward.
10. Prohibited Activities
You may not use the Services for any illegal activities, spam, distribution of malware or other harmful purposes. Violations may result in deactivation of the eSIM and account suspension.
11. Liability
BuddySIM's liability is based on the statutory provisions; In the case of simple negligence, we are only liable for breach of essential contractual obligations (cardinal obligations) and limited to the foreseeable damage that is typical for the contract. Liability for damages resulting from injury to life, body or health as well as under the Product Liability Act remains unaffected. We do not guarantee uninterrupted or error-free availability. You are responsible for the proper installation/configuration; We are not liable for roaming charges due to incorrect configuration.
12. Changes to the Terms and Conditions
We may change these terms and conditions. Changes will be announced in the app; In the event of significant changes, we will obtain your consent, if necessary. Further use after notification is otherwise deemed to be consent.
13. Final provisions & Contact
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG); Mandatory consumer protection regulations in your country of residence remain unaffected. The exclusive place of jurisdiction for merchants is Swisttal. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
