By accessing or using the digital services of 7 Marketplace GmbH, Vorgebirgsstraße 11, 53913 Swisttal, Germany (hereinafter”vendors“or”BuddySim”), in particular via the website www.buddysim.com or via mobile applications and platforms from distribution partners, the user declares that he has read and accepted the privacy policy and the general terms and conditions (GTC).
By using the services — regardless of whether the purchase is made directly via the BuddySIM Shop or through an authorized sales partner — a legally binding contract is concluded between the user and 7 Marketplace GmbH.
The user expressly assures that he is legally authorized to conclude such a contract and has full legal capacity within the meaning of the applicable legal provisions.
1. Scope
1.1 These General Terms and Conditions (GTC) apply to all contracts between 7 Marketplace GmbH, Vorgebirgsstraße 11, 53913 Swisttal, Germany (hereinafter “Provider” or “BuddySim”), trading under the BuddySIM brand, and the customer for the purchase and use of digital eSIM data packages concluded via the online platform or mobile application of an authorized sales partner.
1.2 The respective specific features and country-specific usage instructions are derived from the product information sheet of the booked data package. This is provided to the customer by the provider or the sales partner before the purchase and is part of the contract.
1.3 Deviating conditions of the customer only apply if they have been expressly agreed to in writing.
2. Subject matter of the contract and services
2.1 7 Marketplace GmbH, trading under the BuddySIM brand, offers customers digital prepaid eSIM data packages for using mobile data services on eSIM-compatible devices. The services are provided both via our own online shop at www.buddysim.com as well as provided through authorized resellers.
2.2 Depending on the sales channel, the eSIM is ordered, paid for and provided either via the BuddySim website or via the infrastructure of an authorized sales partner. Payment is processed via common payment service providers, in particular Stripe, Shopify, PayPal or as part of technical integration with the respective sales partner.
2.3 The eSIM will be made available to the customer electronically immediately after conclusion of the contract, e.g. by email, WhatsApp or the web application and app of the respective sales partner. The information required for installation and activation is supplied to the customer or made available electronically.
2.4 Acceptance of these terms and conditions is required to use the services. As part of the purchase and registration, the customer provides certain personal data, in particular first name, last name, email address and billing address.
2.5 Before ordering, the customer is obliged to check on his own whether his device is eSIM compatible and not connected to the network. A non-binding compatibility overview is available at www.buddysim.com/check retrievable. The customer is responsible for the accuracy of the information.
2.6 The provider undertakes to provide the contractually agreed services with customary market care and technical accuracy. There is no guarantee of uninterrupted, error-free or always available use. 2.7 The customer undertakes not to use the services unlawfully, abusively or fraudulently. In the event of violations, the provider reserves the right to temporarily or permanently block access to the service. The obligation to pay remains unaffected by this.
3. Contract start, activation and validity
3.1 The contract between the customer and 7 Marketplace GmbH, trading under the BuddySIM brand, is concluded upon completion of the order process via the online shop or an authorized sales partner.
3.2 The eSIM purchased at buddysim.com must be activated within 60 calendar days of the date of purchase. If no activation takes place within this period, the eSIM expires without replacement. There is no right to a refund after that. The eSIM purchased through a reseller must be activated within 6 months of the date of purchase. If no activation takes place within this period, the eSIM expires without replacement. There is no right to a refund after that.
3.3 The period of use of the booked data package begins when the eSIM is connected to a foreign mobile network for the first time (roaming) and is — depending on the package selected — 7, 15 or 30 calendar days.
3.4 The period of validity of an unused eSIM is based on the offer conditions valid at the time the contract is concluded. For eSIM products that before May 6, 2025 have been purchased, an activatable validity of 12 months from the date of purchase applies, regardless of the volume of data booked. The eSIM must be activated for the first time within this period. If no activation takes place within the time limit, the credit expires without replacement. Regardless of the respective package duration, the eSIM remains valid for a period of twelve (12) months after each active use (data connection abroad). For eSIM products that after May 6, 2025 have been purchased, an activatable validity of 6 months from the date of purchase applies, regardless of the volume of data booked. Regardless of the respective package duration, the eSIM remains valid for a period of six (6) months after each active use (data connection abroad). Within this period, it can be used again or charged with a new data package (top-up). If no further use is made within this period, the eSIM profile is automatically deactivated and can no longer be used. The period of validity of a data package (7, 15 or 30 days) begins with the first use of at least 1 KB of data volume in the respective network of the target country. An eSIM can be charged and reused as often as you like after use. After the expiry of the respective validity period, the eSIM loses its validity and the end user requires a new eSIM. For limited-time special promotions, including free packages or promotions, there are different, in particular shortened, validity periods. The applicable deadlines will be clearly communicated as part of the corresponding action. Promotional bundles that have not been activated within the specified time period can be automatically deactivated or removed after expiry.
3.5 The contract automatically ends upon deletion of the eSIM from the smartphone, expiry of the booked data package period and/or expiry of the eSIM in accordance with paragraph 2 or 4. A separate cancellation by the customer is not required.
4. Prices and terms of payment
4.1 Depending on the sales channel, the eSIM is ordered, paid for and provided either via the BuddySim online shop at www.buddysim.com or via the infrastructure of an authorized sales partner.
4.2 Payment is processed via external payment service providers, in particular Stripe, Shopify, PayPal, Apple Pay or Google Pay. When using an authorized sales partner, processing can be carried out directly via their platform. In this case, tokenized payment data (such as payment tokens and transaction references) is securely transmitted to BuddySIM for final settlement without complete payment information being processed or stored by BuddySim.
4.3 All payments are made in euros (€), unless otherwise expressly stated.
4.4 All prices quoted are gross prices including statutory value added tax, unless expressly stated as net prices.
4.5 The customer is only entitled to set off against claims made by 7 Marketplace GmbH against undisputed or legally established counterclaims.
5. Obligations of the customer
5.1 Before concluding the contract, the customer is obliged to check on his own responsibility whether his device is technically suitable for using an eSIM, in particular whether it is eSIM-compatible, activated (network-independent) and suitable for international mobile connections. A non-binding overview of supported devices is available at www.buddysim.com/check retrievable. The provider does not guarantee functionality on devices that are not on the list or have not been properly activated.
5.2 The customer undertakes to use the eSIM data packages provided exclusively within the framework of the contractually agreed purpose, in particular only for approved mobile data use.
5.3 Misuse, illegal or improper use, including — but not limited to — commercial transfer, manipulation of network configuration, falsification of a location (e.g. using VPNs to circumvent geographical restrictions), automated data retrieval or other non-contractual use, entitles the provider to immediately block or delete the eSIM profile without prior notice.
5.4 A claim for reimbursement in the event of suspension as a result of an infringement in accordance with paragraph 5.3 is excluded.
5.5 The customer is obliged to store access data, QR codes and installation information securely and not to make them accessible to third parties. Sharing or duplicating the eSIM for use by third parties is expressly prohibited.
5.6 When using the eSIM, the customer also undertakes to comply with all applicable national and international legal regulations, in particular those of the respective country of residence.
6. Refund/cancellation/change policy
If the customer is a consumer within the meaning of § 13 BGB, he has a right of withdrawal in accordance with the statutory provisions. The details of the right of withdrawal, the conditions for a refund and the early expiry of the right of withdrawal for digital content are set out in the separate Withdrawal policy, which is part of these terms and conditions.
6.1 Right of withdrawal and refund conditions
6.1.1 Consumers within the meaning of Section 13 BGB are generally entitled to a right of withdrawal of fourteen (14) days from the date of purchase, provided that the eSIM has not yet been activated or used. It is used in particular when the eSIM has been installed on a device and connected to a mobile network.
6.1.2 A full refund is possible under the following conditions: the eSIM was neither installed nor activated, or the eSIM was simply installed, but the booked data package was not activated, i.e. there is no connection to the foreign network.
6.1.3 A partial refund may be granted at BuddySim's discretion insofar as: the eSIM was activated but more than 99% of the data volume remained unused and/or the data package could not be used due to proven technical faults attributable to BuddySim. 6.1.4 The decision on the refund will be made within five (5) working days of receipt of a justified request. The repayment will be made within a reasonable period of time, but no later than thirty (30) calendar days, depending on the payment service provider and the customer's bank.
6.2 Submission of an application
6.2.1 Refund requests must be submitted in writing to refund@buddysim.com. The customer is obliged to provide all information required for verification, in particular: proof of purchase, information on the eSIM used (ICCID or order number), description of the problem, technical evidence, if applicable, such as screenshots, settings or error reports.
6.2.2 Compliance with the refund period of 14 calendar days from the date of purchase is a prerequisite for processing the claim. Refunds after this period are excluded.
6.3 Exclusions and special cases
6.3.1 No refund or credit will be made with:Use of alternative devices, SIM cards, providers or other telecommunications services not provided via BuddySIM; accidental purchases if the eSIM has already been activated — in which case it is considered used; costs not directly related to the BuddySim service (e.g. hotel phones, roaming charges due to misconfiguration); deleted eSIMs after use: Refund is excluded if, after activation, the eSIM has been activated without prior Consultation with Support was removed or deleted from the device.
6.3.2 BuddySim reserves the right to refuse refunds at any time in the event of demonstrable misuse, violation of these terms and conditions, or fraudulent use. If fraud or misuse is suspected, the relevant customer account may be blocked.
6.3.3 In the case of unauthorized or unauthorized purchases, a refund will only be made after individual review and approval by the provider.
6.4 Incorrect invoice amounts
6.4.1 If the customer complains in good faith about an invoice amount, the objection must be made in writing within fourteen (14) days of receipt of the invoice. The customer must explain: which amounts he considers to be incorrect, why the calculation is incorrect, and which amount is considered correct.
6.5 Reimbursement in case of power failure guarantee
6.5.1 BuddySIM offers a network failure guarantee in the event that you do not have Internet access in your destination country for an uninterrupted period of more than 90 minutes. In such a case, we will refund you 100% of the costs for the affected eSIM. The network failure guarantee only applies if it can be proven that the Internet failure is due to a network fault or an error in the BuddySim service. As proof, a screenshot with date and time stamp or a screen video showing that the correct network and APN settings were active during the outage is required.
6.5.2 Refunds will only be made in cases of verifiable technical unavailability of the service, provided that no mobile data connection can be established despite proper installation and active participation of the user as part of the support process. A general right of withdrawal or revocation beyond the statutory provisions is excluded.
6.5.3 BuddySIM provides a network failure guarantee in the event of a verifiable, uninterrupted failure of the mobile Internet service over a period of more than 90 minutes, provided that this failure is due to a technical fault for which BuddySim is responsible. The prerequisite for claiming the network failure guarantee is the timely submission of suitable evidence by the user, such as screenshots, connection test logs or comparable documents, which make it possible to trace the failure.
6.6 Goodwill scheme
6.6.1 Refund requests that do not fall under the above rules will be reviewed on a case-by-case basis. Approval is given exclusively on a goodwill basis. In exceptional cases where a refund is granted outside the regular refund conditions, a processing fee of a maximum of five (5) EUR may apply. The amount depends on actual audit and administrative costs.
6.6.2 The maximum refund amount must in no case exceed the total amount originally paid.
7. Fair use policy for “unlimited” products
[You can use 1GB of data at full speed every day. Once you have reached this limit, the speed is reduced to 5 Mbps for the rest of the day. The next day, starting at 0:00 in the time zone where you are staying, you'll get 1 GB of high-speed data again.

What does throttling mean?
Throttling means a temporary reduction in your network speed after you've exceeded the daily data limit. This is a common practice for managing network resources and ensuring that all users enjoy a stable and reliable connection.]
7.1 eSIM bundles called “Unlimited” have a fair use policy to ensure network quality and stability for all users.
7.2 A daily high-speed data volume of 1 GB is available to the user. Once this volume has been reached, the bandwidth is automatically reduced to up to 5 Mbps by 0:00 (local time of the respective country of residence).
7.3 The reduced bandwidth still allows use for the following purposes: downloading files (e.g. 1 GB in approx. 30 minutes), HD streaming on a device without interruptions, smooth browsing, online gaming and video conferencing with reasonable latency.
7.4 The use of the data connection via mobile hotspots (tethering) is subject to the same regulations as direct use on the device.
7.5 Bandwidth throttling is an automated technical measure and is carried out exclusively to ensure an even distribution of network resources in accordance with the Fair Use Policy.
Important note in case of exceptionally high data consumption: With exceptionally high data consumption per day (more than 10 GB, for example) Can your data usage be subject to an automated check. In such cases, the transfer speed may be temporarily reduced or data access may be restricted. This serves to protect the network from congestion by individual users.
Please note: These measures will exclusively from the local network operator carried out. BuddySim has no influence on this process and can neither prevent nor eliminate throttling.
example: If you consume a particularly large amount of data during peak hours — for example due to continuous streaming or large uploads — you may notice a reduced speed at times or your access may be limited. This is a common practice for maintaining network quality and generally only affects users with significantly above-average consumption. So even with so-called “unlimited” tariffs, there are restrictions in accordance with the fair use policy of the respective network operator. One excessive or abusive use can lead to throttling — this is in order to be fair to other users on the same network.
8. Liability and disclaimers
8.1 Within the framework of legal provisions, BuddySim is only liable for damages based on intentional or grossly negligent breach of duty. In the event of a slight negligent breach of essential contractual obligations (cardinal obligations), liability is limited to foreseeable damage typical of the contract. Any further liability — in particular for indirect damage, subsequent damage or loss of profit — is excluded.
8.2 BuddySIM does not guarantee the continuous, uninterrupted or error-free availability of the services or network connections offered. In particular, the quality and availability of mobile Internet access from third-party providers (e.g. local network operators abroad) cannot be guaranteed.
8.3 The customer himself is responsible for the proper installation, activation and configuration of the eSIM on his device. BuddySim is excluded from liability for damage or malfunctions that are due to faulty or incomplete installation of the eSIM, improper configuration or incorrect settings, use of a device that is not eSIM compatible or blocked, or failure to comply with the instructions provided by BuddySim.
8.4 BuddySim is not liable for roaming charges or other costs arising from the fact that the eSIM profile was not correctly installed or deactivated, mobile data connections remained active (e.g. via another SIM card), the customer did not properly configure his mobile telephone tariff, or caused a parallel connection via the physical SIM.
8.5 BuddySim assumes no liability for damage or loss as a result of loss, theft or misuse of the terminal device or eSIM by unauthorized third parties.
8.6 By purchasing and using an eSIM product from BuddySim, the customer declares that they have taken note of these liability regulations. Any further claim for compensation is excluded, to the extent permitted by law.
8.7 In the event of technical uncertainties or problems, the customer is expressly recommended to contact customer support at support@buddysim.com before making an independent configuration.
9. Final provisions
9.1 The law of the Federal Republic of Germany applies, excluding the UN Sales Convention (CISG). The legal provisions restricting the choice of law vis-à-vis consumers abroad remain unaffected.
9.2 If the customer is a merchant, legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is the registered office of 7 Marketplace GmbH, currently in 53913 Swisttal, Germany.
9.3 Amendments and additions to these general terms and conditions must be made in writing. This also applies to the removal of the written form requirement itself, unless a stricter legal form is required.
9.4 Should a provision of these general terms and conditions be or become invalid or unenforceable in whole or in part, the effectiveness of the remaining provisions remains unaffected. Instead of the ineffective provision, the provision that comes closest to the economic purpose is considered agreed.
9.5 The European Commission provides a platform for online dispute resolution (OS platform), which you
